One of the conditions of civil liability is the existence of a direct
causal link between the unlawful conduct of the offender and the
losses of the injured party. That is, the wrongful act or omission of the
perpetrator is the cause, and the losses incurred by the victim are the
result of the unlawful conduct of the offender.
In order to establish liability for a civil offense, in addition to the
above-mentioned three objective conditions - wrongdoing, damages
and causation, in general rule, another condition is required - the
guilty party's guilt.
5.3. The concept of discipline, legality, law and order, their
guarantees.
Joint activity of people and coexistence is impossible without
orderliness and observance of social norms. The rigorous
implementation of the current rules of conduct is called discipline.
Depending on the sphere of activity of subjects of social relations,
discipline may be state, labour, production, military, educational, etc.
Depending on the way of ensuring discipline can be conscious or
coercive. The discipline implies the necessity of fulfilling the
requirements that follow not only from the legal norms, but also from
other social norms. Since the most important aspects of social
relations are regulated by legal norms, the principle of discipline
includes the requirement of observance of legal norms.
Since the legal norms establish a certain order in society, the
observance of legal norms creates prerequisites for the establishment
of the rule of law and order.
Lawfulness is a prerequisite for the harmonious functioning of
civil society.
Lawfulness is strict and full implementation of the rules of laws
by all subjects of legal relations.
Lawfulness can be defined as a legal regime under which the
activities of all state bodies, legal and natural persons are carried out
in accordance with the requirements of the law.
The main principles (requirements) of legality are:
- supremacy of the rule of law. All laws of the country must
comply with the Constitution, and by-laws – with laws. The decisions
