3 STATE SUPERVISION AND PUBLIC CONTROL OVER THE
OBSERVANCE OF THE LAWS AND OTHER REGULATIONS ON
LABOR PROTECTION
3 .1 State Supervision over Occupational Safety
According to the Law of Ukraine "On labour protection", state supervision
over the observance of the laws and other regulations on labor protection is carried
out (Figure 3.1):
the central executive authority implementing the state policy in the sphere
of labor protection (The State Labour Service of Ukraine - Derzhpratci);
the central body of executive power implementing the state policy in the
field of nuclear and radiation safety (State Nuclear Regulatory
Inspectorate of Ukraine);
the central executive authority implementing the state policy on the issues
of supervision and control over compliance with the legislation in the field
of fire and technogenic safety (The State Emergency Service of Ukraine);
the central executive authority implementing the state policy in the sphere
of sanitary and epidemic welfare of the population. (March 29, 2017, the
government decided to liquidate the State Sanitary and Epidemiological Service, as its
functions are performed by the other agencies)
The State Labour Service of Ukraine - Derzhpratci includes a number of
local branch-specific administrations and respective subordinate inspections
specialized in particular kinds of control.
Officials of the central body of executive power implementing the state policy
in the field of labor protection have the right to:
1) unobstructed visit the enterprises at any time to check compliance with the
law on matters within their competence (in the presence of the employer or his
representative);
2) receive written or oral explanations, expert examinations, audits, materials
and information on relevant issues from the employer and officials, reports on the
level and status of preventive work, the reasons for violations of the law and
measures taken to eliminate them;;
3) issue, in due course, to employers, managers and other officials of legal and
natural persons who, in accordance with the legislation, use hired labor, ministries
and other central bodies of executive power, the Council of Ministers of the
