1 THE LEGAL AND REGULATORY FRAMEWORK ON
OCCUPATIONAL SAFETY
Labour protection legislation comprises the Law of Ukraine “On Labour
Protection”, Labour Code of Ukraine, Law of Ukraine “On Mandatory State Social
Insurance” and respective regulatory legal acts adopted in conformity with the above-
mentioned.

1. 1 Statements of Occupational Safety in the Constitution of
Ukraine
Fundamentals of the Ukrainian legislation on occupational safety is the
Constitution of Ukraine (Articles 43, 45, 46), which guarantees citizens the right to
labor and safety.
In Article 43 of the Constitution of Ukraine recorded "Everyone has the right to labour,
including the possibility to earn one's living by labour that he or she freely chooses or to which he
or she freely agrees.", "Everyone has the right to proper, safe and healthy work conditions", "The
employment of women and minors for hazardous to their health is prohibited."
Article 45 of the Constitution of Ukraine "Everyone who is employed has the right to rest”.
This right is ensured by providing weekly rest days and also paid annual vacation, by establishing
a shorter working day for certain professions and industries, and reduced working hours at night”.
In Article 46 of the Constitution of Ukraine reads: "Citizens have the right to social
protection that includes the right to the provision in cases of complete, partial or temporary
disability, the loss of the principal wage-earner ….. and in other cases established by legislation”.
