- Ukraine's right to own armed forces, national guards and state
security bodies.
National sovereignty is the right of the nation to determine its
fate as envisaged by the UN Charter, the 1966 International Covenant
on Civil and Political Rights. This right has been proclaimed in the
Section I of the Declaration on the State Sovereignty of Ukraine.
The implementation of the right to self-determination of the
Ukrainian nation was the Declaration of Independence of Ukraine on
August 24, 1991, confirmed by the All-Ukrainian referendum on
December 1, 1991.
3. Relations, which characterize the basic principles of state
functioning.
The humanism, democracy, division of power, the expression of
which is the mechanism of counterweights, mutual control of power
branches, their balance are the main principles. They ensure the
stability and purposefulness of state functioning, its social nature.
4. Relations related to the definition of the basis of legal status
of a person and his/her guarantees. They are the following:
- relations of citizenship – it means the constant legal
relationship between the individual and the state, which gives them
the corresponding rights and imposes the certain responsibilities;
- relations of Ukrainian citizens’ fundamental rights: economic,
political, social, cultural, environmental;
- relations of guarantees for realization of rights and freedoms;
- relations arising from the fact of state responsibility to the
person and vice versa.
The constitutional law of Ukraine is one of the most important
means of ensuring the people's sovereignty in the political, economic
and socio-cultural spheres of their life. The Constitution has the
highest legal force in the whole system of legislation, being the basis
of Ukrainian legislation, envisages the conformableness of all
legislative acts with the Constitution of Ukraine and specifying its
provisions.
These circumstances determine the leading and decisive role of
constitutional law in the system of national law of Ukraine. While
acting as the core of the system of national law and integrating its
branches into one whole, constitutional right penetrates into each of
these areas. First of all, it is ensured by the Constitution of Ukraine –
