2.1. Constitutional law as a branch of law, legislation and
science.
The leading branch in the system of national law of Ukraine is
the constitutional law. This branch has inherent features that are
characteristics for the whole system of law: normativeness, formal
certainty, orientation to achieve a certain legal result, the possibility of
protecting legal requirements by means of state influence, etc.
At the same time, it is characterized by specific qualitative
features such as the subject and method of legal regulation, social
purpose and the role of constitutional law, the principles of
constitutional regulation, the tasks and functions of constitutional law,
the existence of constitutional (constitutional and legal) responsibility.
By fixing and regulating the sovereignty of people, the legal
status of a person and a citizen, the organization and activities of state
authorities and the state as a whole, the principles of local self-
government of Ukraine, the constitutional law in that way answers the
question: who owns power in the society and how it is implemented,
i.e. what mechanism of its implementation.
The specifics of constitutional law are, firstly, that it contains the
fundamental provisions that are decisive for other branches of law,
and secondly, that it has a special subject of legal regulation – social
