A citizen of Ukraine is a person who has acquired the
citizenship of Ukraine in the manner prescribed by the laws of
Ukraine and international treaties – Ukraine.
The issues of citizenship of Ukraine are regulated by the
Constitution of Ukraine, the Law of Ukraine "On Citizenship" of
January 18, 2001, and international treaties of Ukraine. In this case, if
the international treaty of Ukraine establishes rules other than those
contained in the legislation of Ukraine, the rules of the international
agreement should be applied. The legislation of Ukraine on citizenship
is based on the principles:
1) single citizenship – the citizenship of the state of Ukraine,
which excludes the possibility of citizenship of political subdivisions
of the territory of Ukraine. If a citizen of Ukraine has acquired
citizenship of any other country or countries, in legal relations with
Ukraine he/she will be recognized only as a citizen of Ukraine. If a
foreign citizen has received the Ukrainian citizenship, in legal
relations with Ukraine, he/she is recognized only as a citizen of
Ukraine;
2) prevention of statelessness;
3) impossibility of Ukrainian citizens being deprived of
Ukrainian citizenship;
4) recognition of the Ukrainian citizen’s right to change his/her
citizenship;
5) impossibility of a foreign subject or a stateless person to
become automatically a citizen of Ukraine as a result of marriage with
a citizen of Ukraine or acquisition of Ukrainian citizenship by wife
(husband) and automatically termination of Ukrainian citizenship by
one of the spouses due to the termination of marriage or the
termination of Ukrainian citizenship by another spouse;
6) equality of Ukrainian citizens before, irrespective of the
grounds, procedure and moment of their acquisition of Ukrainian
citizenship;
7) retention of Ukrainian citizenship, irrespective of the place of
residence of Ukrainian citizen.
Citizens of Ukraine are:
1) all citizens of the former USSR who on the date of
proclamation of Ukraine's independence (August 24, 1991) were
permanent were residents on the territory of Ukraine;
