The Law of Ukraine "On the Legal Status of Foreigners" of
February 4, 1994 (currently – “On the Legal Status of Foreigners and
Stateless Persons”) defines the legal status of foreigners in Ukraine,
establishes the basic rights, freedoms and obligations of foreign
citizens and stateless persons who reside or temporarily reside in
Ukraine.
Foreigners are recognized citizens – persons belonging to the
citizenship of foreign states and are not citizens of Ukraine, and
persons without citizenship – persons who do not belong to the
citizenship of any state.
Foreigners have the same rights and freedoms and perform the
same duties as citizens of Ukraine, unless otherwise provided by the
Constitution and other laws of Ukraine, as well as international
treaties of Ukraine.
Foreigners who have committed a crime, administrative or other
offenses, are responsible for general grounds. If the international
treaty of Ukraine sets other norms than those contained in Law on
the Legal Status of Foreigners and Stateless Persons, then the rules of
the international agreement will apply.
For example, by regulating the acquisition of Ukrainian
citizenship by birth, the current legislation of Ukraine establishes that
a person, parents or one of whose parents were citizens of Ukraine at
the moment of his/her birth, is a citizen of Ukraine. A person born in
the territory of Ukraine from stateless persons who legally reside in
the territory of Ukraine is a citizen of Ukraine. A person born outside
of Ukraine from persons without citizenship, who permanently legally
reside in the territory of Ukraine, and has not acquired the citizenship
of another state at birth, is a citizen of Ukraine. A person born in the
territory of Ukraine from foreigners who permanently legally reside in
the territory of Ukraine and does not acquire any parent’s citizenship
at birth, is a citizen of Ukraine. A person born in the territory of
Ukraine, one of whose parents has been granted refugee status in
Ukraine or an asylum in Ukraine, and has not acquired one of the
parents’ citizenship at birth or has acquired the citizenship of the
parent who has been granted refugee status in Ukraine or an asylum in
Ukraine, is a citizen of Ukraine. A person born in the territory of
Ukraine from a foreigner and a stateless person who permanently
legally resides in the territory of Ukraine and has not acquired the
